TERMS & CONDITIONS FOR HANS PLACE PRACTICE
These terms and conditions of Business (“Terms and Conditions”) apply to the supply of services by Hans Place Practice. In the event of any inconsistency between these Terms and Conditions and the contents of other literature provided by Hans Place Practice to the Patient, these terms and conditions shall prevail.
1. DEFINITIONS AND INTERPRETATIONS
“Consent Form” – The consent form signed by the Patient consenting to the relevant Procedure.
“Doctor” – A general medical practitioner registered to practice in the United Kingdom.
“Fee” – The Fee charged by Hans Place Practice for the Procedure.
“In writing” – A dated signed letter sent to the Clinic Manager or by email to reception@hansplace.com. In either case, the Patient must receive a written acknowledgment of cancellation from the Clinic Manager.
“Nurse” – A nurse registered to practice by the Nursing and Midwifery Council.
“Patient” – Any person who has entered or is contemplating entering a contract with Hans Place Practice for a Procedure.
“Patient’s Guide” – An information pack made available to the Patient by Hans Place Practice.
“Procedure” – A procedure arranged by Hans Place Practice for a Patient and performed by a Doctor or Surgeon.
“Products” – Any cream or other product purchased from Hans Place.
“Surgeon” – A medical practitioner registered with the General Medical Council and a Fellow of the Royal College of Surgeons (or equivalent).
“Working Day” – Monday to Friday, excluding UK Bank or public holidays.
2. HANS PLACE PRACTICE OBLIGATIONS
2.1 Ensure the Procedure is carried out by an appropriately trained Doctor or Surgeon.
2.2 Ensure the Doctor or Surgeon is insured against professional negligence by a recognised organisation.
2.3 Ensure the Doctor or Surgeon holds all necessary qualifications and registrations.
2.4 Provide suitable facilities for Procedures.
2.5 Provide the Patient with reasonable information to understand and decide on the Procedure.
3. THE PATIENT’S OBLIGATIONS
3.1 Read and understand all information and instructions before consenting to a Procedure.
3.2 Ask questions to ensure full understanding of the Procedure.
3.3 Attend follow-up appointments as advised.
3.4 Ensure timely payment for any Procedure.
4. THE SURGEON AND DOCTOR’S OBLIGATIONS AND RELATIONSHIP
4.1 Surgeons and Doctors are independent contractors and not employees of Hans Place Practice. They are directly accountable to the Patient.
4.2 Surgeons and Doctors are solely responsible for clinical information, risks, outcomes, and suitability assessments.
4.3 They are also responsible for follow-up care.
4.4 Hans Place Practice is not liable for the outcome of Procedures; that responsibility lies with the Surgeon or Doctor.
5. PAYMENT FOR A PROCEDURE
5.1 The Patient must pay the Consultation Fee when booking an appointment.
5.2 A booking is confirmed only after a minimum £500 deposit is paid. Full payment is required at least 6 working days before the Procedure. Failure to do so may result in cancellation, unless the Doctor/Surgeon deems the Patient unfit for the Procedure.
5.3 The refund policy outlined in this section applies to all payments.
6. CANCELLATION AND POSTPONEMENT CONDITIONS
6.1 If a Procedure is booked within 2 weeks of consultation and then cancelled, the Patient is entitled to a full refund.
6.2 If a Procedure is cancelled 2 weeks or more after consultation: More than 6 working days before – no charge; Between 2 and 6 working days – £500; Less than 2 working days – 35% of the total fee.
6.3 A Procedure may be postponed for up to 6 months if paid in full. For medical postponements with proof, no charge applies. For IV Sedation cases, the anaesthetist’s fee will be charged unless reassigned. A doctor’s report is required within 10 days. Future fees will reflect the fee schedule on the new booking date.
6.4 A Surgeon may cancel or postpone a Procedure if the Patient is unfit or the Procedure is deemed inappropriate. In case of cancellation, a full refund will be provided, minus fees for services already rendered.
6.5 Hans Place Practice may change the date/venue due to unforeseen circumstances. No refund will be given, but an alternative date within 6 weeks or up to 12 months will be offered.
6.6 All notices of cancellation or postponement must be in writing to the Clinic Manager.
6.7 Products purchased are non-refundable.
7. FURTHER CHARGES
The Patient must cover costs for any pre-operative investigations requested for their well-being, such as blood tests or x-rays.
8. RE-ADMISSIONS POLICY
8.1 If the result does not meet agreed expectations, the Surgeon or Doctor may consider further treatment.
8.2 If additional surgery is necessary to achieve the expected outcome, it will be provided free of charge (excluding IV sedation fees).
8.3 If revision surgery is optional but justified, a theatre fee of £600 will apply, plus IV sedation if chosen.
8.4 Within 12 months of the original operation, clinical complications will be addressed free of charge. Personal expenses (e.g., travel) are the Patient’s responsibility.
8.5 General tests within 28 days post-op and ultrasounds within 6 months (if requested by the Surgeon) will be provided free of charge. After this period, costs are the Patient’s responsibility.
This policy applies only if:
a) The Patient attended all follow-up appointments.
b) The Patient submitted a written complaint within 4 months.
c) The result was not compromised by lifestyle, illness, ageing, or failure to follow post-op care.
d) Only the original Surgeon/Doctor is responsible for the outcome. If unavailable, Hans Place Practice may not provide revision surgery.
9. COMPLAINTS
9.1 Complaints must be made in writing to the Clinic Manager. A response confirming investigation will be sent within 21 working days.
9.2 The complaint may be discussed with involved practitioners. An additional consultation may be required. If unresolved, an independent complaints officer will review the case.
9.3 Once resolved, all parties will be informed of the outcome.
9.4 If unsatisfied, the Patient may contact an independent advocate or Citizens Advice Bureau.
10. CONFIDENTIALITY AND DATA PROTECTION
10.1 Hans Place Practice processes Patient data according to these Terms.
10.2 Relevant data may be disclosed to Clinicians or Technicians for procedural purposes.
10.3 Patients are deemed to consent to this disclosure.
10.4 Except where legally required, data will not be shared with third parties.
11. LAW AND JURISDICTION
11.1 These Terms are governed by English law.
11.2 Both parties agree to the exclusive jurisdiction of the English courts.
